Terms of Service

1. Agreement
These Terms of Service govern your access to and use of Aizen Analytics ("Aizen", "we", "us"). By creating an account, using the dashboard, sending events to Aizen, or otherwise using the service, you agree to these Terms.
If you use Aizen on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility and Accounts
You must provide accurate account information, keep your credentials confidential, and promptly notify us of unauthorized access to your account. You are responsible for all activity that occurs under your account, including invited users, API keys, and public share links created from it.
Aizen supports email/password accounts and optional Google sign-in. Some users may access sites only as invited guests without a separate personal paid plan.
3. Service Description
Aizen provides privacy-first analytics tools, including event collection, dashboards, aggregated reporting, realtime views, goals, funnels, shared dashboards, read-only site API keys, notification emails, optional proxy mode, and optional integrations such as Google Search Console. Features may vary by plan, account status, and product availability.
4. Customer Responsibilities
You may use Aizen only for websites or apps that you own, operate, or are authorized to measure. You are responsible for your implementation, your configuration choices, your legal notices, and any required consent or disclosure obligations that apply to your properties.
You are also responsible for the actions of your invited team members, anyone with access to a public share link you enable, and anyone to whom you disclose a site API key.
5. Prohibited Data and Acceptable Use
You may not use Aizen to violate the law, infringe rights, disrupt the service, attempt unauthorized access, interfere with rate limits or technical controls, or send malicious code.
You must not send sensitive or prohibited data through Aizen, including health data, biometric data, children's data, government identifiers, payment card data, account passwords, session tokens, API secrets, or other high-risk personal data. This restriction applies to custom events, page URLs, built-in click-tracking URLs or CTA identifiers, Search Console connections, and any other data you cause Aizen to process.
6. Team Access, Share Links, and API Keys
Site owners can invite guest users, enable public share links, and create read-only site API keys where the product allows it. These features are optional and are turned on at the customer's discretion.
Public share links may expose aggregated analytics to anyone who has the link. API keys are bearer credentials and must be stored securely. You are responsible for rotating or revoking compromised keys and regenerating share links that should no longer be accessible.
7. Trials, Plans, and Payment
Aizen may offer free trials, paid subscriptions, guest-only access modes, or other plan structures. Trial availability, duration, and eligibility are determined by the product as offered at the time. Current direct signups may receive a 14-day trial, while invited guest users may remain guest-only until they start a personal paid plan.
Paid subscriptions automatically renew until canceled. Billing is handled by Stripe. You authorize us and our payment processor to charge applicable recurring fees, taxes, and permitted adjustments using the payment method on file. Fees are non-refundable except where required by law.
If payment fails, a subscription becomes past due, or a trial expires, we may limit features, stop accepting new events, suspend account capabilities, or terminate access as permitted by the product and these Terms.
8. Usage Limits and Feature Gating
Plans may include limits on event volume, number of sites, team members, retention, API keys, or other product features. Aizen may reject, drop, or stop processing new events that exceed plan limits or violate validation, origin, bot, or abuse controls.
Certain features, including owned-site creation, Search Console access, notifications, or plan changes, may be available only to site owners or only while an account is in an eligible subscription state.
9. Customer Data
You retain your rights in the data you submit to Aizen or instruct Aizen to process on your behalf ("Customer Data"). You grant Aizen the limited rights needed to host, process, secure, transmit, store, display, and otherwise use Customer Data to operate the service.
Any visibility, sharing, or deletion controls are limited to the features the service makes available at the time. We do not claim ownership of Customer Data.
10. Aizen Intellectual Property
The Aizen service, software, design, documentation, trademarks, and related materials are owned by Aizen or its licensors. Except for the limited access rights granted under these Terms, no rights are transferred to you.
11. Availability and Product Changes
We may update, modify, suspend, or discontinue any part of the service at any time, including plan features, limits, integrations, APIs, and user interface behavior. We do not guarantee uninterrupted availability, perfect accuracy, or continued support for any specific feature.
12. Suspension and Termination
You may stop using the service at any time. Site deletion is immediate through the product where supported. Account deletion currently includes a 7-day grace period before final removal.
We may suspend or terminate access if you breach these Terms, fail to pay fees, create material security risk, use the service unlawfully, or otherwise misuse Aizen. Sections that by their nature should survive termination will survive, including payment obligations, disclaimers, liability limits, indemnity, and governing law.
13. Privacy and Compliance
Our handling of data is described in the Privacy Policy and, where applicable, the Data Processing Agreement. Aizen is designed to minimize persistent tracking, but you remain responsible for determining whether your use complies with laws applicable to your organization, properties, and users. Aizen does not provide legal advice.
14. Disclaimer
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Aizen disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
Analytics results depend on customer implementation, browser behavior, blockers, network conditions, filters, origin validation, bot filtering, and other factors outside our control.
15. Limitation of Liability
To the maximum extent permitted by law, Aizen and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business interruption, arising out of or related to the service or these Terms.
Our aggregate liability for all claims arising out of or related to the service will not exceed the greater of (a) the amounts you paid to Aizen for the service during the 12 months before the event giving rise to the claim or (b) USD $100.
16. Indemnification
You will defend, indemnify, and hold harmless Aizen and its affiliates, officers, employees, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your use of the service, your Customer Data, your violation of these Terms, or your violation of applicable law or third-party rights.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware and the United States, without regard to conflict of laws rules. Any dispute arising out of or related to these Terms or the service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue there.
18. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. These Terms, together with the policies they incorporate by reference, are the entire agreement between you and Aizen regarding the service.
